01 Scope of service

What you get when employing foreigners

  • 01

    Recruitment and candidate verification

We search our own database, job advertisements and referrals. We check qualifications, experience and the completeness of documents before a candidate arrives at your company.

  • 02

    Legalisation of work and stay

We prepare the documentation and coordinate the residence and work formalities. So far, 100% of our legalisation applications have been approved.

  • 03

    Accommodation near the plant

We provide every out-of-town worker with accommodation close to the workplace. Transport is arranged where needed.

  • 04

    A dedicated coordinator

One person runs the project, in constant contact with you and with the workers. The coordinator responds to health, family and work-related situations, which reduces turnover.

  • 05

    Document control during cooperation

We keep track of the completeness and validity of workers' documents, so your company does not have to do it on its own.

  • 06

    Flexible scale

We increase or reduce the number of workers in line with your demand. If someone resigns, we take action to provide a replacement as quickly as possible, in line with the terms of cooperation.

02 When it makes sense

When to entrust the employment of foreigners to an agency

Situation 01

You are short of workers on the line or in the warehouse

When the local labour market does not supply candidates fast enough, we fill the positions from our own database and handle all the formalities.

Situation 02

The number of orders is growing

Higher volume requires a dozen or several dozen people at once. We organise recruitment, legalisation and accommodation in one process.

Situation 03

You have no in-house team to handle formalities

The rules changed in 2025 and require handling through the praca.gov.pl portal. We take over this burden instead of tying up your HR department.

Situation 04

You want to reduce the risk of inspections

We check documents and the legal basis for work, and you have one partner responsible for the process.

03 Good to know

Which documents provide the legal basis for a foreigner's work

The most common bases for entrusting work to a foreigner are a work permit (zezwolenie na pracę), a declaration on entrusting work to a foreigner (oświadczenie o powierzeniu wykonywania pracy cudzoziemcowi, for citizens of Armenia, Belarus, Moldova and Ukraine) and a seasonal work permit. A foreigner may also work, among other grounds, on the basis of a residence and work permit or, as a citizen of Ukraine, on the basis of a notification (powiadomienie) to the labour office. The rules are set out in the Act of 20 March 2025 on the conditions for allowing foreigners to be entrusted with work (ustawa o warunkach dopuszczalności powierzania pracy cudzoziemcom), applied since 1 June 2025.

Since 1 June 2025, applications for a work permit and declarations are submitted exclusively electronically through the praca.gov.pl portal, and documents submitted in any other form are left unprocessed. A work permit is issued by the voivode (wojewoda) at the employer's request, and the foreigner must have a residence title. The declaration on entrusting work applies only to citizens of the countries listed in a ministerial regulation, and that list was changed with effect from 1 December 2025.

Official sources also state that the employer no longer carries out a labour market test, although the starost (starosta, head of the district) may specify occupations in which a permit is refused, and some visas (including those issued for transit and by other Schengen states) do not entitle the holder to work on the basis of a permit or declaration. The employer is also subject to obligations towards the office, including providing a copy of the contract and notifying whether or not the foreigner has started work. We determine which document is right in your case at the needs analysis stage.

06 FAQ

Frequently asked questions

The employer must entrust the work on a proper basis, most often a work permit, a declaration on entrusting work or a seasonal work permit, and the foreigner must have a residence status that entitles them to work. Applications are submitted electronically through praca.gov.pl. At Back2Work we run this process for you, from recruitment to legalisation.

They depend on the basis of employment. For a work permit, the offices list, among other things, certificates of no tax arrears and no social security (ZUS) contribution arrears, as well as documents signed electronically by an authorised person: with a qualified electronic signature, a trusted signature (podpis zaufany) or a personal signature (podpis osobisty). We determine the set for your company after a needs analysis.

No. Since 1 June 2025 the employer no longer carries out a labour market test. However, the starost may specify occupations in which, because of the situation on the local labour market, a work permit is refused, so before submitting an application we check the list for the given district.

No. Since 1 June 2025 applications for a work permit and declarations are submitted exclusively electronically through the praca.gov.pl portal. Documents submitted in any other form are left unprocessed.

The time depends on the basis of work and the workload of the office. For a work permit, voivodeship offices (urzędy wojewódzkie) usually indicate a processing time of up to one month, and up to two months in complex cases, and they warn of possible delays. That is why we plan legalisation in advance. Candidates who already have the right to work in Poland can be assigned faster.

Recruitment, document verification, legalisation of work and stay, accommodation and project coordination by a dedicated coordinator. Your company receives staffed positions and one contact person.

Yes. We provide accommodation near the plant for all out-of-town workers, and we arrange transport where needed.
